1. Introduction & Agreement

1.1. These Terms and Conditions ("Terms") govern your use of the PCGaming S.A. website ("www.pcgamingsa.co.za") and the purchase of goods from PCGaming S.A. ("we", "us", "our"). By accessing our website and/or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.

1.2. If you do not agree to these Terms, you must not use our website or place any orders.

1.3. We reserve the right to refuse service to any person, for any reason, at any time, at our sole discretion.

3. Definitions

"Consumer" means any natural person who enters into a transaction with PCGaming S.A. primarily for personal, domestic, or household use.

"Goods" means any gaming hardware, components, peripherals, accessories, or related items sold through our website.

"Order" means a request by you to purchase Goods from us.

"Business Day" means any day other than a Saturday, Sunday, or public holiday in the Republic of South Africa.

4. Use of Website

4.1. You must be 18 years of age or older to make a purchase. By placing an order, you warrant that you are at least 18 years old and legally capable of entering into binding contracts.

4.2. You agree to use our website only for lawful purposes.

4.3. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including but not limited to cases of suspected fraud, abuse, stock manipulation, violation of these Terms, or any activity we deem harmful to our business interests.

4.4. We may restrict access to parts of our website, or the entire website, at our discretion without prior notice.

5. Product Information, Pricing & Availability

5.1. All images and descriptions are indicative only. We do not guarantee that your monitor's display will accurately reflect the actual product colours, finishes, or dimensions.

5.2. All product specifications are provided by the manufacturer. PCGaming S.A. is not responsible for errors, omissions, or changes in manufacturer-provided specifications.

5.3. Product prices are subject to change without notice. We reserve the right to correct pricing errors at any time, even after an order has been placed. If a pricing error is discovered, we may cancel the order and refund any amounts paid.

5.4. All products are subject to availability. We reserve the right to discontinue any product at any time without notice.

5.5. We reserve the right to limit quantities sold per customer, per order, or per address, at our sole discretion.

6. Pricing and Payment

6.1. All prices are listed in South African Rand (ZAR) and are inclusive of VAT at the applicable rate.

6.2. We accept: PayFast, Yoco, EFT, and PayJustNow.

6.3. Payment must be made in full before Goods will be dispatched. For EFT, Goods will only be dispatched once payment has cleared, which may take up to 3 Business Days.

6.4. Orders not paid within 48 hours of placement may be cancelled at our discretion without notice.

6.5. For custom-built PCs, pre-orders, or special-order items, we may require a non-refundable deposit of up to 50% before work commences.

6.6. In the event of a chargeback, payment dispute, or reversed transaction, we reserve the right to withhold delivery, cancel the order, and/or suspend the customer's account until the dispute is resolved.

7. Orders and Acceptance

7.1. Placing an order constitutes an offer to purchase. All orders are subject to acceptance by PCGaming S.A. We are not obligated to accept any order.

7.2. A contract is formed only when we send an order confirmation email.

7.3. We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, pricing errors, or suspected fraudulent activity.

7.4. If we cancel an order after payment, we will refund the full amount within 14 Business Days.

8. Delivery

8.1. All delivery timeframes are estimates only and do not constitute guarantees. Time is not of the essence unless expressly agreed in writing.

8.2. Delivery timeframes commence from the date of order confirmation and cleared payment, not the date of order placement.

8.3. We are not liable for any delay in delivery caused by circumstances beyond our reasonable control, including but not limited to: courier delays, stock shortages, adverse weather, strikes, pandemics, public holidays, or acts of government.

8.4. Estimated delivery timeframes: Cape Town 2–4 days, Johannesburg/Pretoria 3–6 days, Durban 3–6 days, rest of South Africa 5–10 days.

8.5. We shall not be liable for any loss, damage, or inconvenience arising from any delay in delivery, regardless of the cause.

9. Returns, Refunds & Cancellations

9.1. Defective Goods (CPA Section 55): If Goods are defective, not of acceptable quality, or unfit for purpose, we will, at our discretion, provide repair, replacement, or refund. Claims must be reported within 6 months of delivery.

9.2. Goods must be returned in original, undamaged packaging, unused, with all accessories and documentation. We reserve the right to reject returns that do not meet these conditions.

9.3. A 15% handling and restocking fee may apply to returns that are not due to defects.

9.4. The following cannot be returned: opened software/digital codes, opened earphones/headsets, gift cards, custom-built PCs, and special-order items (unless defective).

9.5. Return shipping costs are the customer's responsibility unless Goods are confirmed defective by PCGaming S.A.

9.6. Refunds will be processed within 14 to 21 Business Days of us receiving and inspecting the returned Goods.

10. Warranty

10.1. All Goods carry the manufacturer's standard warranty. PCGaming S.A. facilitates warranty claims but is not the warrantor and is not liable if the manufacturer declines a claim.

10.2. Warranties do not cover damage caused by misuse, negligence, unauthorised modifications, physical damage, liquid damage, or normal wear and tear.

11. Custom Builds & Special Orders

11.1. Custom-built PCs and special-order items are non-returnable and non-refundable except where defective under CPA Section 55.

11.2. A non-refundable deposit of up to 50% is required before work commences on any custom build.

11.3. Custom build timeframes are estimates only. We are not liable for delays caused by component availability or supplier lead times.

12. Limitation of Liability

12.1. Our total liability to you in respect of all losses arising under or in connection with any order shall not exceed the total amount paid for that specific order.

12.2. We are not liable for any indirect, consequential, incidental, or special losses, including but not limited to: loss of profits, loss of data, loss of business, or business interruption.

13. Force Majeure

13.1. We shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including: acts of God, war, terrorism, pandemics, government restrictions, strikes, fires, floods, power failures, supplier shortages, or courier disruptions.

14. Intellectual Property

14.1. All content on this website is the property of PCGaming S.A. and is protected by copyright, trademark, and other intellectual property laws. Unauthorised use may result in legal action.

15. Governing Law & Disputes

15.1. These Terms are governed by the laws of the Republic of South Africa.

15.2. Any dispute shall first be attempted to be resolved through good faith negotiation. If negotiation fails, the dispute shall be subject to the exclusive jurisdiction of the South African courts.

16. Amendments

16.1. We reserve the right to amend these Terms at any time without prior notice. Changes are effective immediately upon posting. Your continued use constitutes acceptance of the revised Terms.
